HOLIDAYS SWEEPSTAKES
OFFICIAL RULES

1. NO PURCHASE IS NECESSARY TO ENTER OR WIN.


2. The Orlando Sentinel’s Holiday’s Sweepstakes (“Sweepstakes”) is sponsored by Orlando Sentinel Communications Company d/b/a The Orlando Sentinel, 633 North Orange Avenue, Orlando, FL 32801 (“Sponsor” or the “Orlando Sentinel”) and the prize provider is Tuffy Associates Corp.


3. The geographic scope of this Sweepstakes is the Florida counties of Orange, Osceola, Brevard, Volusia, Flagler, Lake, Marion, Polk and Seminole.

4. Void where prohibited by law and outside the above-listed counties.  By entering, entrants agree to these Official Rules. Limit one entry per person. Multiple entries from the same person will be disqualified. Any attempt by any entrant to obtain more than the stated number of entries using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Sponsor not responsible for electronic communications that are undeliverable as a result of any form of active or passive filter in of any kind. The use of automated or third party software or web site to participate is prohibited. All received entries become the property of the Sponsor and will not be returned.   

5. Sweepstakes begins on November 2, 2012 at 12:01 a.m. Eastern Time (“ET”) and ends on November 30, 2012 at 11:59 p.m. ET (the “Sweepstakes Period”). The Orlando Sentinel’s computer is the official time-keeping device for this Sweepstakes.

ELIGIBILITY

6. All entrants must be 21 years of age or older and legal U.S. residents residing in Orange, Osceola, Brevard, Volusia, Flagler, Lake, Marion, Polk, or Seminole County at the time of entry.

7. Employees (and members of their immediate families (defined as spouse, parents, siblings or children and household members) of  Orlando Sentinel Communications Company, Tribune Company, Tuffy Associates Corp. and any agencies involved with the Sweepstakes and the respective parents, subsidiaries, affiliates and franchisees of the foregoing (collectively, the “Sweepstakes Entities”) are not eligible to enter or win.

PRIZES

8. Three Grand Prizes: Each Winner will receive an Apple iPad with Wi-Fi - 16 GB.

            Approximate retail value (“ARV”) of each prize is: $499.99. Total ARV of all prizes: $1,499.97.

9. The odds of winning depend on the number of eligible entries.

PRIZE RESTRICTIONS

10. Prizes, subject to terms and conditions thereon. All details of prizes are at Sweepstakes Entities’ sole discretion. Winners assume sole responsibility for all costs associated with the prize not explicitly outlined above, including without limitation, all federal, state and local taxes (if any).

11.  Prizes not redeemable for cash and may not be transferred or rescheduled to dates not within the fulfillment period set forth above except that Sweepstakes Entities may do so if they deem necessary. Any such changes will be announced. If the actual value is less than the approximate retail value, difference in prize value will not be awarded.

12. Prizes offered are provided “as is” with no warranty or guarantee either express or implied by Sweepstakes Entities.

TO ENTER

13. Entries will be accepted during the Sweepstakes Period. There are two ways to enter. To enter online, visit www.orlandosentinel.com/sweepstakes locate the “Sweepstakes” link on the page and accurately complete the online entry form; or 2) to enter by hand, visit any Tuffy location in Orange, Lake, Seminole, Volusia and Osceola counties, accurately complete (all entries must be handwritten) on official Entry Form (while supplies last) and deposit it in the drop off box.  

14. Entries must include a valid email address for the entrant.  If there is a dispute as to the identity or eligibility of a winner based on an email address, the winning entry will be deemed made by the “Authorized Account Holder” of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person, 21 years of age or older, who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

15. All Entry Forms become the property of the Orlando Sentinel and will not be returned or acknowledged.

16. The information that you provide in connection with the Sweepstakes will be used by the Orlando Sentinel in accordance with its Privacy Policy, which is found at www.orlandosentinel.com and which may be updated from time to time, and also by Tuffy Associates Corp.

PRIZE DRAWING

17. On December 3, 2012 or within a reasonable time thereafter, the Orlando Sentinel or its designee will randomly choose three Grand Prize winners from all eligible entries. Subject to verification of eligibility, the persons whose names are so drawn will be declared the winners.

WINNER NOTIFICATION

18. The Orlando Sentinel will attempt to contact potential winners in accordance with the information supplied to the Orlando Sentinel on the potential winners’ Entry Forms.  Winners may be verified over the telephone at the time and may be asked to provide the Orlando Sentinel with valid identification and execute an affidavit of eligibility and a publicity release.  Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address.  Faxes will not be accepted.  The winners may also be required to sign other legal documents, including tax forms and a release supplied by the Orlando Sentinel that, among other disclaimers, releases Sweepstakes Entities and their respective officers, directors, employees and related persons from any and all liability related to this Sweepstakes and the receipt and use of any prize.  Any required documents must be signed and returned to the Orlando Sentinel with 24 hours of the time such documents are sent to winner and prior to receipt of prize. Upon verification of eligibility, the names of winners may be posted on the Orlando Sentinel’s website at www.orlandosentinel.com.   

19. If potential winner (a) cannot be contacted directly by the Orlando Sentinel within one day from initial attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, (d) or is otherwise determined to be ineligible, the Orlando Sentinel in its discretion may disqualify that individual and an alternate winner will be chosen by random drawing to be held as soon as reasonably practicable after initial winner is determined to be ineligible.  Alternate winner is subject to all eligibility requirements and restrictions of these Official Rules. Orlando Sentinel may conduct up to one alternate drawing. If Orlando Sentinel is unable to confirm an eligible winner for prize after one alternate drawing, no further drawings will be conducted for that prize and that prize will not be awarded.

PUBLICITY RELEASE

20. By accepting a prize, winners grant the Orlando Sentinel the right to publicize the winners’  names, photographs (including the use and appearance of winners’ photographs on the Orlando Sentinel’s web page), likenesses, biographical information, email addresses, voices and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY

21. Entrants agree that the Sweepstakes Entities and their respective directors, agents, officers, employees and related persons: (a) are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not received by the Orlando Sentinel by the deadlines stated above; (b) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Sweepstakes or downloading of any software or materials; (c) are released from any and all liability related to this Sweepstakes and the receipt and use of the prize; and (d) will not be responsible for the inability to select winner because of equipment failure, or data storage failure. 

MISCELLANEOUS

22. The Orlando Sentinel is entitled to interpret these Official Rules — including but not limited to rules regarding entries, selection of winner, deadlines, restrictions on prize, and eligibility — and all of its decisions are final.  By entering, entrants agree to these Official Rules. 

23. The Orlando Sentinel reserves the right to cancel, terminate or suspend this Sweepstakes or any part of this Sweepstakes should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Sweepstakes as determined by the Orlando Sentinel in its sole discretion, at which time, the Orlando Sentinel will select the winners by conducting a random drawing from among all non-suspect entries received at the time of the Sweepstakes cancellation, termination or suspension. If Orlando Sentinel does so, it will post notice of its action on the Sweepstakes website.

24. The Orlando Sentinel reserves the right to prohibit any entrant from participating in the Sweepstakes if, at its sole discretion, the Orlando Sentinel finds such entrant to be tampering with the entry process or the operation of the Sweepstakes, or if such entrant shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Orlando Sentinel determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner.  Any person attempting to defraud or tamper with this Sweepstakes in any way will be ineligible for prize.   Tampering includes attempting to enter more than the number of times permitted by these Official Rules by using an automated device or by using more than one email address.  Any failure by the Orlando Sentinel to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.

25. The Orlando Sentinel reserves the right to correct typographical or clerical errors in any Sweepstakes-related materials.  No more than the stated number of prizes will be awarded.  If production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Orlando Sentinel reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

DISPUTES

26. By entering the Sweepstakes, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. 

27. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or of Sponsor in connection with Sweepstakes, will be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Florida.  Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules must be instituted only in the federal or state courts located in the State of Florida, County of Orange and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
